Former Amtrak employee receives 20 months in prison in health care fraud case

NEWARK, N.J. — A former Amtrak employee has been sentenced to 20 months in prison and ordered to pay almost $960,000 in restitution for his part in a fraud scheme that saw the Amtrak health care plan pay more than $11 million in false claims.

Devon Burt, 53, of Blue Bell, Pa., received the sentence on Oct. 7, the U.S. Attorney’s Office for the District of New Jersey announced. Sentencing followed his guilty plea in June 2023 for conspiracy to commit health care fraud and conspiracy to communicate extortionate threats. Along with the prison time, he received two years’ supervised release and an order to pay $959,072.

Burt worked with health care providers to recruit Amtrak employees in a scheme that offered cash payments in exchange for allowing health care providers to use their information to submit false claims; those providers received payments from the health care plan for services that were never provided or were medically unnecessary. Burt received cash payments for the use of his information and for recruiting others to take part. He and another conspirator made phone calls and sent text messages indicating a health care provider would be injured if that provider did not pay a conspirator several thousand dollars.

Burt is one of 19 people prosecuted as a result of the fraud investigation. All have pleaded guilty to conspiracy to commit health care fraud.
